These Terms and Conditions govern the use of the Future Form™ website and the purchase of any products from it.

All content on the Future Form™ website, including text, graphics, logos, images, and software, is the property of Future Form™ or its suppliers and is protected by copyright and intellectual property laws.

3. Use License

Permission is granted to temporarily download one copy of any downloadable materials on the Future Form™ website for personal, non-commercial, transitory viewing only.

4. Disclaimer

Future Form™ products are provided "as is", except where explicitly covered by Future Form™’s limited warranty for manufacturing defects.

Future Form™ makes no other warranties, express or implied, beyond those explicitly stated in the warranty terms. This includes, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights.

5. Limitation of Liability

In no event shall Future Form™, its directors, employees, affiliates, or suppliers be liable for any damages, including without limitation damages for loss of data or profit, or due to business interruption, arising out of the use or inability to use the website or products, to the fullest extent permitted by law.

6. Accuracy of Materials

The materials appearing on Future Form™’s website may include technical, typographical, or photographic errors. Future Form™ does not warrant that any materials on its website are accurate, complete, or current.

7. Links to Third-Party Websites

Future Form™ has not reviewed all sites linked to its website and is not responsible for the contents of any such linked site.

8. Modifications to Terms

Future Form™ may revise these Terms and Conditions at any time without notice. Continued use of the website constitutes acceptance of the revised terms.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Estonia. You irrevocably agree to the exclusive jurisdiction of the Estonian courts for any disputes arising out of or in relation to these Terms and Conditions. This applies irrespective of the location of the customer or the destination of the shipped goods.

10. User Responsibilities

Users agree to use the Future Form™ website and its products lawfully and ethically. Any misuse, fraudulent activity, or violation of these Terms and Conditions may result in termination of access or refusal of service.

11. Product Use and Medical Disclaimer

Future Form™ red light therapy products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.

Customers should consult a healthcare professional before using the products, especially if they have pre-existing conditions or are undergoing medical treatment. Future Form™ is not responsible for any adverse effects resulting from the use or misuse of its products.

12. Orders and Payments

All orders placed through the website are subject to acceptance and availability.

Future Form™ reserves the right to cancel any order at its discretion, including but not limited to suspected fraud, incorrect pricing, or supply issues.

Prices are listed in USD, EUR, or another specified currency and include all applicable charges, sales tax, customs duties, and standard import fees based on conditions at the time of order.

Customers will not be charged additional fees upon delivery under normal shipping conditions.

However, all prices are subject to adjustment in accordance with the Shipping Cost Adjustments and Surcharges clause, including but not limited to carrier-imposed surcharges, war risk fees, and other extraordinary external cost increases.

13. Shipping and Delivery

Future Form™ ships worldwide but cannot guarantee delivery times due to customs, carrier delays, or unforeseen circumstances.

Customers are responsible for providing accurate shipping information. Future Form™ is not liable for lost or delayed shipments caused by incorrect address information provided by the customer.

Prices include applicable taxes, customs duties, and standard import fees based on conditions at the time of order.

Additional charges resulting from carrier-imposed surcharges, regulatory changes, or extraordinary external events (including but not limited to war, sanctions, or supply chain disruptions) are not included and may be charged separately to the customer.

13.1 Shipping Cost Adjustments and Surcharges

All shipping rates, freight charges, and logistics costs are based on conditions at the time of quotation.

Future Form™ reserves the right to adjust shipping costs after an order has been placed in the event of increases imposed by carriers, freight forwarders, or authorities beyond its control.

Such adjustments may include, but are not limited to:

– War risk surcharges (WRS)

– General rate increases (GRI)

– Fuel surcharges (BAF or similar)

– Congestion surcharges

– Emergency route deviations or transshipment costs

– Port closures, sanctions, or geopolitical disruptions

Any such additional costs shall be the responsibility of the customer and may be invoiced prior to delivery or required to be paid before the shipment continues to its final destination.

14. Order Cancellations and Refunds

14.1 General

Order cancellations or modifications requested by the customer are subject to the terms below. All cancellation requests must be submitted in writing and are subject to approval by Future Form™.

14.2 Cancellation Before Production Begins

If an order is canceled before production or manufacturing has started, a cancellation and processing fee of up to 10 percent of the canceled item’s purchase price may apply. This fee covers administrative handling, payment processing fees, and inventory reservation.

14.3 Cancellation After Production Has Begun but Before Shipment

If an order is canceled after production has begun but before shipment, a cancellation fee of up to 20 percent of the canceled item’s purchase price may apply. This reflects production preparation, materials allocation, labor, and non-refundable processing costs.

14.4 Cancellation After Shipment

If an order is canceled after the product has shipped, a cancellation and restocking fee of up to 30 percent of the purchase price may apply. Shipping costs, return shipping costs, customs fees, and carrier charges are non-refundable and remain the responsibility of the customer.

Returned products must be unused, undamaged, and in their original packaging. Future Form™ reserves the right to inspect returned items and deny refunds if return conditions are not met.

14.5 Custom Made or Made to Order Products

Custom made, personalized, or made to order products are manufactured specifically for the customer and cannot be resold.

If a custom or made to order product is canceled:

• Before production begins, a cancellation fee of up to 20 percent may apply
• After production has begun, cancellation may result in a fee of up to 50 percent, or the order may be deemed non-refundable, depending on the stage of production

Custom orders that are already in production or completed are not eligible for full refunds unless defective upon arrival.

14.6 Payment Processing Fees

All payment processing fees charged by third-party payment providers are non-refundable and may be deducted from any approved refund.

14.7 Refund Processing

Approved refunds are issued to the original payment method and are typically processed within 7 to 14 business days, depending on the payment provider and financial institution.

15. Returns and Refunds

Customers may request a return within 60 days from the delivery date, provided the product is unused and in its original packaging.

Future Form™ reserves the right to deny returns or refunds for used, damaged, or altered products.

Due to the made-to-order nature of the products, returns are limited. Custom made or personalized products cannot be returned unless defective upon arrival.

Return shipping costs are the responsibility of the customer unless the product is defective or incorrect.

16. Warranty and Repairs

16.1 General Warranty Coverage

Future Form™ provides a limited warranty covering manufacturing defects in materials and workmanship for a period of 1 to 5 years, depending on the product, from the date of delivery.

All warranty claims must be supported by valid proof of purchase and reported within the applicable warranty period.

16.2 Red Light Therapy Beds - Warranty Policy

Due to the size, complexity, and highly modular construction of our red light therapy (RLT) beds, warranty service follows a repair-first policy focused on efficient component replacement.

During the 5-year warranty period for RLT beds, Future Form™ will provide, at no cost to the customer:

• Free replacement spare parts for any manufacturing defects
• Full professional repair service: we will arrange and send a qualified local technician from our partner network in your area at no cost to you, or cover a reasonable fee for your electrician to perform the repair and part replacement
• Clear video or written repair guides if you prefer to handle minor fixes yourself
• Technical support and troubleshooting guidance

All necessary parts are shipped free of charge - smaller components via express delivery and larger parts by sea freight. We aim to respond to every warranty claim within 24–48 hours.

Our RLT beds are designed to be highly modular, meaning most issues can be quickly resolved by replacing the affected component. Based on the product design and historical performance, all functional failures are considered repairable through component replacement.

Accordingly:

• Warranty service for red light therapy beds is fulfilled primarily through free parts replacement, professional repair support, and guided self-repair where appropriate.
• Full machine replacement is not provided as a standard warranty remedy.
• Future Form™ does not offer full unit replacement for red light therapy beds, even if multiple components require replacement.

16.3 Panels, Masks, Mats, Wraps, and Other Non-Bed Products – Warranty Policy

For red light therapy panels, masks, mats, wraps, and other non-bed products, Future Form™ provides a more flexible warranty remedy.

During the applicable warranty period for these products, Future Form™ may, at its discretion:

– Provide free replacement parts

– Offer guided repair support

– Replace the product with a new or refurbished unit if it is confirmed to be irreparable

– Issue a full or partial refund if replacement is not reasonably feasible

Future Form™ reserves the right to determine whether a product is repairable or irreparable based on technical assessment, photos, videos, and troubleshooting results.

16.4 Shipping Damage and Lost Shipments

If a product is damaged or lost during transportation:

– The customer must report the issue within 48 hours of delivery and provide clear photographic and video evidence of the packaging and product condition

– Future Form™ will assist the customer in filing a claim with the freight forwarder and/or insurance provider

– Any compensation, repair, or replacement outcome is subject to the final assessment and decision of the responsible carrier or insurance company

For red light therapy beds specifically:

– Future Form™ conducts quality inspections prior to shipment; severe transit damage is rare

– In the event a bed is lost in transit, and the freight forwarder or carrier formally confirms the loss and compensates Future Form™ for the shipment, Future Form™ will arrange shipment of a replacement bed to the customer

– In cases of severe transit damage, the outcome may include repair, parts replacement, partial compensation, or other remedies depending on the insurance company’s assessment

– Compensation outcomes may be partial or full, depending on the insurer’s decision

– Future Form™ is not obligated to ship a full replacement bed unless and until compensation is received from the responsible carrier or insurer

– Where compensation is partial, Future Form™ may provide repair parts, partial refunds, or alternative remedies at its discretion

For non-bed products (panels, masks, mats, wraps, and accessories):

– Once carrier liability is confirmed, Future Form™ may arrange a replacement or refund at its discretion

16.5 What Is Not Covered

The warranty does not cover:

– Normal wear and tear or cosmetic damage

– Damage caused by misuse, abuse, improper installation, or failure to follow instructions

– Unauthorized repairs or modifications

– Damage from accidents, impacts, power surges, or unsuitable electrical setup

– Environmental factors affecting performance

– Damage caused during transportation after delivery, except as outlined in Section 16.4

– Accessories unless defective upon arrival (such as goggles, straps, mounting hardware and etc.)

16.6 Shipping and Service Costs

Shipping costs for warranty claims are not covered unless otherwise agreed in writing.

Future Form™ may cover shipping, spare parts delivery, customs charges, and technician or electrician costs when these are explicitly approved in advance in writing.

17. Indemnification

Users agree to indemnify and hold harmless Future Form™, its affiliates, and employees from any claims, damages, liabilities, and legal fees arising from their use of the website or products.

18. Chargebacks and Payment Disputes

By placing an order, customers acknowledge and agree to these Terms and Conditions, including all cancellation, refund, and return policies.

Customers agree to contact Future Form™ directly and allow a reasonable opportunity to resolve issues before initiating a chargeback or payment dispute.

Chargebacks submitted in contradiction to these Terms and Conditions may be considered unauthorized, fraudulent, or submitted in bad faith.

Future Form™ reserves the right to contest disputes and recover associated fees and losses where permitted by law, refuse future service, pursue civil remedies, or report suspected fraud to authorities.

19. Title and Risk of Loss

Ownership and risk of loss pass to the customer upon delivery to the carrier. Future Form™ is not responsible for loss, damage, or delay caused by carriers, customs authorities, or third parties beyond its control, except as required by law.

20. Refused or Unclaimed Shipments

Orders that are refused, unclaimed, or returned due to incorrect address information may be subject to cancellation, return shipping costs, customs charges, and restocking fees. Any refund will be reduced by applicable costs incurred.

21. Pricing Errors

In the event of an obvious pricing or typographical error, Future Form™ reserves the right to cancel or refuse any affected order. A full refund will be issued where applicable.

22. Order Modifications

Requests to modify orders after placement are subject to approval and may be treated as cancellations under the Order Cancellations and Refunds section. Additional fees may apply.

23. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms and Conditions constitute the entire agreement between the customer and Future Form™ and supersede all prior communications unless explicitly agreed otherwise in writing.

25. Acceptance of Terms

By accessing the website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

26. Force Majeure

Future Form™ shall not be held responsible for delays, increased costs, or failure to perform obligations due to events beyond its reasonable control, including but not limited to war, armed conflict, sanctions, port closures, carrier disruptions, strikes, pandemics, or government actions.

In such events, Future Form™ reserves the right to:

– Suspend or delay shipment

– Modify shipping routes or logistics arrangements

– Adjust pricing to reflect increased costs

Where performance becomes commercially impractical due to such events, Future Form™ and the customer agree to renegotiate the affected terms in good faith.

27. Privacy and Data Protection

Future Form™ collects personal data only for order processing, marketing where consent is given, and website functionality.

Customer data is not sold or shared except with necessary service providers. Customers may request data deletion in compliance with GDPR and applicable regulations.

28. Termination of Use

Future Form™ reserves the right to terminate website access or refuse service for any reason, including violations of these Terms and Conditions.

29. Dispute Resolution

Future Form™ encourages amicable resolution of disputes. If resolution cannot be reached, disputes shall be settled through arbitration or mediation in Estonia before court proceedings.
